ABSTRACT
“Rights are protected not by laws, but by social and moral conscience of society. The statement empowers the society to an adequate extent by the virtue of the moral power endowed in its structure. The notion is a product of the ideology of Dr. B.R. Ambedkar. Ideologies forwarded by prominent individuals from the history still find a functional space in the same societies. This is one of such notions, which never lost its imminence, rather got strengthened with relative change of time. The legislative reforms introduced by the Government of India gave a light which is worth acclaiming and also, as always Judiciary has come time and again to save man miniature, by its sagacious judgements, from excruciating blows of evil society. Assiduous attempts are being made by Constitution of India, National Commissions and by various ministers, etc regarding the rights of marginalized groups but their successful application is a matter of scepticism. In Indian administrative culture law dwells in complexity if innumerability; which further hampers the success of same legal products. This happens because of lack of adequate interpretation and implementation in fruition. Society treats these people like harlequin in a pantomime. The assertion cannot be denied due to the practicality of the logistics behind human survival in the nature. In opposition it is a well known fact that the circumstances since long could not be ameliorated. This paper encapsulates an authentic attempt to forward a detailed analysis and understanding of the steps taken by government and even dominantly the role of society and Judiciary contributing in the realm and upliftment of marginalized segments with focus on women.
